§ 23.22.008. Height, lot width and yard requirements.

  • (a)

    The following minimum requirements shall be observed subject to the additional requirements, exceptions and modifications as set forth in Chapter 23.38:

    (1)

    No limit on height of structure;

    (2)

    Any lot platted prior to March 1, 2002 may be grandfathered in with a minimum lot width of fifty feet for a single family dwelling, sixty feet for a two family dwelling or eighty feet for a multiple family dwelling. Any lot platted after March 1, 2002 shall have a minimum lot width of one hundred feet;

    (3)

    Front yard shall be twenty-five feet or more;

    (4)

    Side yard shall be seven feet for single or two family structures and twelve feet for multi-family structures;

    (5)

    A side yard abutting a street shall not be less than twenty feet in width;

    (6)

    Rear yard shall be one-half the height of the building or twenty feet, whichever is greater;

    (7)

    Lot area per dwelling unit;

    (A)

    If one through three stories, then two and one-half times the minimum floor are required,

    (B)

    If four through six stories, then two times the minimum floor are required,

    (C)

    If seven stories or over, then one and one-half times the minimum floor are required;

    (8)

    Any lot platted prior to March 1, 2002 may be grandfathered in with a minimum lot area of six thousand square feet. Any lot platted after March 1, 2002 shall have a minimum lot size of ten thousand square feet.

    (9)

    In no case may any structure except for fences be constructed in utility easement areas along front, side or rear property lines.

    (10)

    If a detached accessory building is constructed three feet (or less by variance) from the property line, the roof overhang on the building will be limited to one foot including stormwater gutters.
