§ 23.40.150. Setback.

  • (1)

    APPLICATION. A sign is a structure or a part of a structure for the purpose of applying front yard, side yard, and height regulations.

    (2)

    SETBACK IN B-2 AND B-3: Signs in the B-2 and B-3 zones will be allowed to be one foot from face of sign to front property line and one foot from face of sign to side property line with approval of the city planning and inspections office.

    (3)

    PUBLIC RIGHT-OF-WAY. Signs or sign structures are prohibited within the public right-of-way except that the council may grant a special permit for temporary signs and decorations to be placed on a right-of-way for a period of time not to exceed ninety days, subject to the laws of South Dakota and the ordinances of this city.

    (4)

    FREESTANDING SIGNS. All freestanding signs shall be located in such a location that the land around the sign is landscaped or if a part of an approved parking area, surfaced as required under Section 23.36.006 of this code.

    (5)

    In no case may any sign structure (that part of the sign buried in the earth) be constructed in utility easement areas along front, side or rear property lines.
