§ 24.12.020. Preliminary plats.

  • (a)

    SUBMITTAL. Before dividing any tract of land into two or more parcels the owner or subdivider shall submit to the city planner:

    (1)

    One plain paper copy of the preliminary plat at least ten working days before a regular monthly meeting of the planning commission;

    (b)

    SUBMITTAL FEE. A cash submittal fee shall be paid at the time of submittal. The submittal fee for a minor plat (including three lots or less) shall be set by resolution of the governing board. The submittal fee for a major plat (including four lots or more) shall be set by resolution of the governing board.

    (c)

    PRELIMINARY REPLAT. From time to time a developer may replat a piece of property.

    (1)

    A developer replatting a parcel shall provide the city planner a copy of the new plat and a submittal fee as noted in this section.

    (2)

    If a plat is submitted to the planning office and goes to the city/joint planning commission and city/county commission with no changes, then no final submittal fee will be required. If the plat must be addressed at two or more planning commission meetings before it can be finalized, then both preliminary and final plat submittal fees will be required.

    (d)

    ACTION BY GOVERNING BODY. The governing body shall act on the preliminary plat within ninety days of the date on which it was accepted as filed. If the report of the planning commission has not been received in time to meet this requirement, the governing body may act on the preliminary plat without planning commission recommendation. If the preliminary plat is not approved by the governing body, the reasons for such action shall be recorded in the proceedings of the governing body and transmitted to the applicant. If the preliminary plat is approved, such approval shall not constitute final acceptance of the subdivision by merely general acceptance of the preliminary design. Subsequent approval will be required of the engineering proposals and other features and requirements as specified by this title to be indicated on the final plat.

    (e)

    APPROVAL DEFINED. "Approval" means the acceptance of the design subject to meeting all requirements and recommendations as a basis for preparation of the final plat.

    (f)

    APPROVAL BY ENGINEER. Approval by the city engineer will be required to all engineering proposals presented in the preliminary plat which pertain to such things as water supply, sewage disposal, storm drainage, surface water storage, gas and electric service, road gradients and widths and the grading of streets, prior to the approval of the preliminary plat by the planning commission.
