§ 5.60.008. Franchise term.

  • A franchise may be granted pursuant to this chapter for ten (10) years from the effective date of the Commission's formal approval of the franchise application, subject to one five-year renewal period on the same terms and conditions as contained in this chapter, or on such different or additional terms and conditions as may be lawfully specified by the governing body and as are consistent with the rules and regulations of the FCC. The company's application for franchise renewal may be granted provided company shows that its service during the preceding franchise period has reflected a good faith effort to serve the needs and interests of its service area and company has not demonstrated a callous disregard of the law and all pertinent regulations. Pending final completion of renewal proceedings, the then current franchise agreement shall remain in effect on a six (6) month basis even if the original term has expired. If the then current franchise is not renewed, or it is revoked for cause by the city, the transfer of company's system shall be governed by Section 627 of the Cable Communication Policy Act of 1984, as amended.
