§ 8.04.010. Definitions.

  • (1)

    "Adequate shelter" means protection from the elements generally considered to be standard and accepted for an animal's health and well-being consistent with the species, breed, physical condition, and type of animal.

    (2)

    "Animal" includes any mammal, bird, reptile, amphibian or fish, except humans.

    (3)

    "Animal containment area" means any area wherein an animal is restrained, contained, or restricted to or any enclosure or shelter wherein an animal lives.

    (4)

    "Animal control officer" means a law enforcement officer or any person employed, contracted, or appointed by the Beadle County Humane Society.

    (5)

    "At large" means to be off the premises of the owner and not under the control of the owner or owner's designee. An animal within an automobile of its owner shall be deemed upon its owner's property.

    (6)

    "Impoundment" means taking physical control and custody of an animal.

    (7)

    "Kennel" means any person engaged in keeping four or more dogs or cats of any species who are more than six months of age, for pleasure, profit, breeding, exhibiting, or for commercial business of boarding or trading for a fee on the premises.

    (8)

    "Leash" means a cord, thong, or chain by which an animal is controlled by the person accompanying it.

    (9)

    "Neutered dog/cat" means any male dog/cat which has undergone surgery to prevent reproduction, whose owner can provide proof of surgery.

    (10)

    "Owner" includes any person harboring or keeping an animal or the owner or manager in charge of the establishment or premises at which an animal remains or returns to.

    (11)

    "Spayed dog/cat" means any female dog/cat which has undergone surgery to prevent conception, whose owners can provide suitable proof of such surgery.
