§ 3.02.008. Compensation.

    SALARY.

    (1)

    Salaries for each position classification shall be set by the city commission through the annual certified pay schedule. The governing board shall designate in the certified pay schedule which classifications are eligible for overtime pay.

    (2)

    Police Department Captains.

    (a)

    Within every twenty-eight (28) day work cycle, police captains shall take eight (8) hours off without pay and for pay purposes each bi-weekly time sheet shall show four (4) hours without pay.

    (b)

    Night differential pay: A police captain who works a night shift seven p.m. to seven a.m. (7 PM to 7 AM) shall receive, in addition to the employee's regular hourly wage as reflected in the pay scale, an amount equal to two and one-half percent (2.5%) of the employee's regular hourly wage.

    (3)

    Fire Department—Twenty-seven (27) day schedule. Within every twenty-seven (27) day work cycle, employees shall take twelve (12) hours off without pay.

    B.

    OVERTIME.

    (1)

    Hours related to holiday pay, compensatory time, sick leave pay, and vacation leave pay but not worked shall be counted as hours worked for purposes of determining overtime pay for all employee groups listed below. All overtime must be approved by the employee's supervisor or reviewed by the city commissioner if the employee is supervised by a city commissioner.

    (2)

    Overtime hours will be compensated as set forth below unless the hours worked over the employee's regular work day is the result of flex time scheduling pursuant to Ordinance Number 3.02.012.

    (a)

    Non-exempt Non-Union employees. One and one-half (1½) times the employee's regular hourly rate of pay shall be paid for all work performed in excess of forty (40) hours in any workweek. For employees who have a regular work shift of eight (8) hours, one and one-half (1½) times the employee's regular hourly rate of pay shall be paid for all work performed in excess of eight (8) hours in a day. For employees who have a regular work shift other than eight (8) hours, one and one-half (1½) times the employee's regular hourly rate of pay shall be paid for all work performed in excess of the employee's regular work shift. Hours worked in excess of the employee's regular workday for which the employee receives overtime pay shall not be counted for purposes of determining overtime in excess of forty (40) hours per week.

    (b)

    Police Department Captains and Dispatchers. Police Department Captains and Dispatchers shall be paid overtime at the rate of 1 ½ times the employee's regular hourly rate for all hours worked in excess of eighty (80) hours in a two (2) week period. Overtime shall be paid at the rate of one and one-half (1½) times the employee's regular hourly rate for all hours worked in excess of the regular twelve (12) hour shift.

    (c)

    Fire Department employees. Fire Department employees shall be paid overtime at the rate of one and one-half (1½) times the employee's regular hourly rate for all hours worked in excess of the regular twenty-four (24) hour shift.

    (3)

    The amendments to Section B. of Section 3.02.008 shall be effective December 21, 2008.

    C.

    CALL BACK REPORTING PAY.

    (1)

    Call back reporting pay for non-exempt non union employees. Any employee who is called in to work outside of their regular shift, or schedule, shall be guaranteed at least one (1) hour of work or one (1) hour of pay at the rate of time and one-half (½) their regular rate of pay, except that if an employee is called to work, under the conditions mentioned in this section, between the hours of ten p.m. and six a.m. (10 PM and 6 AM) shall be guaranteed at least two (2) hours of work or two (2) hours of pay at the rate of time and one-half (½) their regular rate of pay. Any employee who is called in to work on Saturday, Sunday or a holiday, at any hour, shall be guaranteed the two (2) hours. This provision shall not apply to employees who are called in to work prior to the start of their regularly scheduled shift and work into and throughout their regularly scheduled shift.

    (2)

    Police Department Captain Call Back Reporting Pay.

    (a)

    A Police Captain who, on less than eight (8) hours notice, is required to report to work outside of their regular shift or schedule shall be guaranteed at least one (1) hour of work or one (1) hour of pay at the rate of time and one-half (1½) their regular rate of pay, except that if a captain is called to work outside their regular shift or schedule between the hours of nine p.m. and 5 a.m. (9:00 PM and 5:00 AM), or a night shift police captain is called to work outside of their regular shift or schedule between nine p.m. and 5 a.m. (9:00 PM and 5:00 AM), they shall be guaranteed at least two (2) hours of work or two (2) hours of pay at the rate of time and one-half (1½) of their regular rate of pay.

    (b)

    Police Captain SWAT team members who, on less than eight (8) hours notice, are called in to work outside their regular shift shall be guaranteed at least two (2) hours of work or two (2) hours of pay at the rate of time and one-half (1½) of their regular rate of pay.

    (c)

    Court Appearance Pay: Should a police captain be in court outside his/her regularly scheduled work hours to testify on a work related matter shall receive overtime for actual court time or two (2) hours, whichever is greater, during an eight (8) hour period. The police captain may elect to receive overtime pay or compensatory time off in lieu of overtime pay. There shall be no court appearance pay if the court hearing was cancelled and the police captain was so informed prior to arriving at court for the scheduled appearance.

    (3)

    Fire Department Employee Call Back Reporting Pay. A fire department employee who is called in to work outside of their regular shift, or schedule, shall be guaranteed at least one (1) hour of work or one (1) hour of pay at the rate of time and one-half (1½) their regular rate of pay.

    D.

    COMPENSATORY TIME.

    (1)

    If any employee works overtime the employee may, with the approval of his supervisor, choose to take compensatory time instead of overtime pay. Compensatory time shall be awarded at the rate of one and one-half (1½) hours of compensatory time for each hour of overtime worked. Compensatory time will only be computed in one (1) hour increments.

    (2)

    Employees may accrue up to forty-eight (48) hours of compensatory time off. Upon an employee accumulating the maximum number of hours of compensatory time off all additional overtime shall be compensated as overtime pay and the employee shall not be entitled to accrue additional compensatory time off until such time as the employee has less than forty-eight (48) hours of accrued compensatory time off.

    (3)

    The employee's intent to take compensatory time instead of overtime pay must be made known prior to the payroll submission date in which the overtime is worked.

    (4)

    The scheduling of the hours to be taken off shall be at the option of the employee, subject to supervisor approval. When an employee requests compensatory time off, the request to take compensatory time off shall be granted provided the time requested does not unreasonably disrupt the department operations.

    (5)

    Non-exempt Non Union employees taking compensatory time off within a pay period may also accrue new compensatory time off in that same pay period. At the employee's option, any overtime earned during such a pay period may either be paid out or accrued for future compensatory time off; with any accrual not to exceed the provisions of Subsection 3.02.008 D.(2).

    (6)

    Comp time rate of pay shall be at the employee's regular hourly rate of pay at the time the comp time is taken.
